Procedural Posture

Criminal Appeal / Appeal Judgment

  1. 1 Whether failure to lift fingerprints was a dereliction of duty by police and favourable to the appellants
  2. 2 Whether the identification of the appellants was reliable
  3. 3 Whether the sentence imposed was excessive given the appellants' status as first offenders

Ratio Decidendi

The appellants were found in recent possession of the stolen vehicle a few hours after the robbery, and their explanations were not reasonably true. There was no dereliction of duty by police in not lifting fingerprints where possession was clear. However, the sentence of thirty years was excessive for first offenders aged twenty and twenty-two; a sentence of fifteen years was appropriate.

Court Disposition

Appeals against conviction dismissed; appeals against sentence allowed; sentences reduced.

Orders

  • Conviction for aggravated robbery upheld (majority); sentence of thirty years set aside; substituted sentence of fifteen years imprisonment with hard labour for each appellant, effective from 5th March, 1979.
