Ratio Decidendi

The second action against the 2nd Respondent was not an abuse of court process because she was not a party to the first action, and enforcement of an equitable mortgage must be commenced by Originating Summons as prescribed by statute. The trial court erred in dismissing the second action as it related to the 2nd Respondent. However, the appeal as it related to the 1st Respondent was dismissed as the action against him was an abuse of process.
