Ratio Decidendi

The Court of Appeal has jurisdiction to grant an injunction pending appeal at first instance under Order 59 Rule 10(9) of the Rules of the Supreme Court 1999, and in the circumstances of this case, the manner in which the High Court handled the application for stay constituted special circumstances justifying the application being made directly to the Court of Appeal. However, the Court cannot grant remedies that would reverse the High Court judgment without hearing the appeal.
