Ratio Decidendi

The Bank of Zambia, as liquidator, has both a fiduciary and statutory obligation under Section 104(3)(a) of the Banking and Financial Services Act to pay the applicants the judgment sum. The trial judge was correct in ordering payment of all monies remaining unpaid by the Liquidation Manager to the applicants. Public policy does not preclude enforcement of court orders against the Bank of Zambia in this context.
