The appellant is only liable to return or refund the value of 300 bags of maize, as only that quantity was seized and returned to its custody. The High Court erred in ordering a refund for 600 bags. The issue of quality was not properly addressed by the trial judge, but the absence of a counterclaim for good grade maize means the respondents are entitled to half the sum paid for the 600 bags.
