The Plaintiff lawfully purchased the house after the recognized sitting tenant (Moffat Banda) declined to buy it. The 2nd Defendant, as a licensee through marriage and without an offer or tenancy agreement, had no legal right to purchase or remain in the house. Equity requires her to pay for use of the house from 1999 until vacating. The Plaintiff must vacate the 3rd Defendant’s flat, which was lawfully sold to her.

Plaintiff’s claim for possession and mesne profits against 2nd Defendant allowed; 2nd Defendant’s counterclaim dismissed; Plaintiff to vacate 3rd Defendant’s flat; costs apportioned as ordered.
