Procedural Posture

  1. 1 Whether the deceased was lawfully employed by the 1st defendant
  2. 2 Whether the defendants owed a duty of care to the deceased
  3. 3 Whether the defendants were negligent in the circumstances of the accident

Ratio Decidendi

The deceased was dubiously and fraudulently employed by an agent of the 1st defendant, did not undergo proper recruitment or induction, and was not in the official records. He sneaked away from work and used a hazardous ladderway, contrary to procedure. Although the ladderway was not maintained, the claim is substantially based on the deceased's own unlawful conduct and fraudulent employment, barring recovery under the ex turpi causa principle. The defendants did not owe a duty of care to the deceased as a lawful employee or visitor, and negligence was not established against them.
