Procedural Posture

Civil Appeal / Judgment on Appeal From High Court, Industrial Relations Division

  1. 1 Whether the appellant unilaterally varied the commission structure and underpaid the respondent
  2. 2 Whether the respondent was constructively dismissed
  3. 3 Whether the respondent was entitled to costs

Ratio Decidendi

The revision of the 2013 commission structure did not amount to a unilateral variation as the respondent accepted the new structure and continued to receive commission without objection. However, the withdrawal of working tools and the poor working relationship with his superior constituted constructive dismissal. Costs were properly awarded as the respondent substantially succeeded in his claims.

Court Disposition

Appeal partially allowed; grounds one and two (commission underpayment) succeed, grounds three and four (constructive dismissal and costs) fail.

Orders

  • Finding of unilateral variation and commission underpayment set aside.
  • Finding of constructive dismissal upheld.
