Ratio Decidendi

The failure by the Plaintiff to file the list and description of documents to be relied on at trial, the list of witnesses to be called at trial, and the letter of demand along with the writ of summons and statement of claim constitutes an irregularity under Order 6, rule 1 of the High Court Rules, as amended. This irregularity is not trivial or merely technical, as these documents are substantive to the merits and preparation of the case. Acceptance of the process by the Registry does not regularise the breach. The stage of proceedings is such that no injustice will be occasioned by setting aside the process, and the Plaintiff may recommence proceedings in compliance with the law.
