The reviewing of the judgment in the absence of the parties and 62 days after it had been entered was highly irregular. The case involved only partial failure of consideration, not total failure, as part of the consideration (cash) was valid. The trial judge was wrong to hold there was no contract and to reverse the original judgment. The appeal was allowed, the reviewed judgment quashed, and the original judgment in favour of the plaintiff restored.
