Procedural Posture

Employment Dispute (wrongful/unfair Dismissal) / Judgment

  1. 1 Whether the Respondent followed the correct disciplinary procedure
  2. 2 Whether the Complainant was unfairly and wrongfully dismissed and entitled to relief
  3. 3 Whether the Complainant is entitled to underpayment of housing allowance, leave days, medical allowance, unpaid salaries and gratuity

Ratio Decidendi

The Respondent failed to follow the mandatory disciplinary procedure by not charging the Complainant with a specific offence or giving him a meaningful opportunity to be heard. There was no substantiated reason for dismissal and no evidence of a proper disciplinary hearing. The dismissal was both wrongful (contrary to contract) and unfair (contrary to statute). The Complainant is entitled to damages for unfair and wrongful dismissal, arrears of salary and allowances, and underpayments, but not gratuity or salary arrears post-termination.

Court Disposition

Complainant's claim for wrongful and unfair dismissal succeeds in part; claims for gratuity and salary arrears post-termination fail.

Orders

  • Respondent to pay Complainant eighteen (18) months' salary (basic plus allowances) as damages for wrongful and unfair dismissal.
  • Respondent to pay arrears of salary and allowances from April 2019 to 5 August 2019, amounting to K83,333.30.
