Ratio Decidendi

The court found that the Plaintiff did not sign the deed of assignment and the assignment to the 2nd Defendant was fraudulent and void. The transaction between the Plaintiff and 1st Defendant was a loan secured by the property, not a sale. The Plaintiff remains the rightful proprietor of Stand No. 462, Chilanga. The interest charged exceeded the lawful limit; the Plaintiff is to repay K300,000 plus 47% interest for six months, and thereafter at the short-term bank deposit rate until judgment, then at the Bank of Zambia lending rate. The Defendants' counterclaim failed.
