Procedural Posture

Civil Appeal / Judgment on Appeal

  1. 1 Whether the trial judge's conduct during trial amounted to procedural unfairness
  2. 2 Whether the payments made were correctly allocated to the respective projects
  3. 3 Whether the appellant was entitled to the claimed contract balance

Ratio Decidendi

The trial judge overreached in his conduct, affecting the fairness of the proceedings, and misapprehended the allocation of certain payments between projects. However, the evidence supported that some payments were correctly allocated to the Guard House project, and the cost of the gate motor, which was not installed by the appellant, should be deducted from the contract sum. The appellant is entitled to the contract balance after these deductions.
