Ratio Decidendi

Plot No. 222/24 Chawama forms part of the estate of the late Golden Milembe Chibwe. Both Applicant and Respondent are beneficiaries as children of the deceased. The property devolves jointly upon them, and title shall be held jointly. The Applicant is entitled to an equal share of future rental income from 1st April 2014 onwards, but not retrospectively. The Respondent is not required to account for past rentals as she was not the administrator. Claims for damages and an account of past rentals are dismissed.
