Ratio Decidendi

The application for extension of time was improperly made under Rule 47 instead of section 85(3) of the Industrial and Labour Relations Act. Even if considered under the correct provision, the appellant failed to provide sufficient and plausible reasons for the inordinate delay in filing the complaint after leaving employment. Judicial discretion to extend time must be exercised judiciously and is not automatic.
