Ratio Decidendi

Upon conversion to common leasehold, the common property attaches as an appurtenant easement to the units and is held by unit holders as tenants in common. The 1st respondent, having disposed of all units, divested herself of all interest in the common property, and any variation or disposal of common property thereafter required unanimous consent of all unit holders. The action was properly commenced by Originating Summons as it sought declaratory relief based on statutory interpretation.
