Ratio Decidendi

There is a separation between the employer's obligations under the contract of employment and the statutory obligations of the pension fund. The employer satisfied Article 189(1) and (2) of the Constitution by retaining the Petitioner on the payroll until terminal benefits under the contract were paid. The obligation to pay the commuted lump-sum pension benefit arises under the LASF Act and is not a basis for continued payroll retention under Article 189(2).
