  1. 1 Whether the payment made to the appellants was redundancy package or long service gratuity
  2. 2 Whether appellants were entitled to long service gratuity upon redundancy
  3. 3 Whether the respondent should bear tax on leave pay

Ratio Decidendi

The appellants were not entitled to long service gratuity upon redundancy as the collective agreement did not provide for it, and the payment made was the negotiated redundancy package despite the erroneous narration. Tax on leave pay was properly deducted as it was not covered by the agreement. However, the respondent's careless mistake in the narration of payments justified depriving it of costs.
