Ratio Decidendi

The Plaintiff is the owner of copyright in the news bulletins and sound recordings produced by its employees, including the 1st Defendant, in the course of employment. The 1st Defendant breached his employment contract by transmitting these materials to the 2nd Defendant without consent and for payment. The 2nd Defendant infringed the Plaintiff's copyright by broadcasting the materials without license. The Plaintiff is entitled to damages, to be assessed. The 2nd Defendant's counterclaim for libel fails for lack of evidence and truth of the statements.
