Procedural Posture

Employment Dispute / Judgment

  1. 1 Whether the complainant's summary dismissal was unfair and/or wrongful
  2. 2 Whether the complainant is entitled to subsistence allowance, unpaid wages, damages, and other reliefs

Ratio Decidendi

The complainant's contract was validly terminated for absence from duty without permission or communication, amounting to desertion, which is a ground for summary dismissal under the Employment Code and the respondent's disciplinary code. Although no disciplinary hearing was held, the failure to follow procedure did not render the dismissal unfair or wrongful as the offence was established. The complainant failed to prove entitlement to subsistence allowance, unpaid wages post-termination, or damages.

Court Disposition

Claim dismissed except for accrued leave days and interest thereon; no order as to costs; leave to appeal granted.

Orders

  • Complainant entitled only to payment of any unpaid leave days as at 16 March 2020, with interest at the short term bank deposit rate from 5 October 2021 to judgment and thereafter at the current lending rate until full payment.
  • All other claims including subsistence allowance, unpaid wages for April and May 2020, damages, and terminal benefits are dismissed.
