Procedural Posture

Civil Appeal / Judgment on Appeal

  1. 1 Whether the appellant's offer letter was genuine or forged
  2. 2 Whether the appellant's interests in the property were extinguished by acceptance of a refund
  3. 3 Whether the contract between the respondent and the third party was enforceable

Ratio Decidendi

The acceptance of the refund by the appellant constituted a rescission of the original contract of sale, extinguishing all rights and obligations under it. The purported repayment by the appellant did not revive the contract, as rescission by agreement is final and there was no evidence of a new enforceable agreement. The respondent was thus the rightful owner of the property, and the appellant's claims failed.

Court Disposition

appeal dismissed
