Ratio Decidendi

The respondent's retirement on medical grounds in October 1991 was not unlawful or null and void as there was sufficient medical basis for retirement under the conditions of service, and the Employment (Special Provisions) Regulations did not apply. However, the respondent was entitled to six months' notice, not four, and should be paid the remaining two months' salary in lieu of notice with interest. Salary arrears, punitive and exemplary damages, and further claims were set aside.
