Procedural Posture

Criminal Appeal / Final Appellate Judgment

  1. 1 Whether the trial court erred in finding that the appellants took control of the car from the deceased by use of force, thereby committing aggravated robbery and murder
  2. 2 Whether the circumstantial evidence was so compelling as to permit only an inference of guilt

Ratio Decidendi

The circumstantial evidence was overwhelming and permitted only an inference of guilt. The appellants were found in possession of the vehicle shortly after the deceased went missing, blood stains were found in the boot, and the deceased was found dead. The appellants offered no explanation for their possession of the vehicle. The evidence of the juvenile witness and the alleged leading to the body were discounted, but the remaining evidence was sufficient to uphold the conviction.

Court Disposition
