Article 8(3) of the NUMAW constitution, which limits the presidency to two terms, is constitutional and does not violate the Industrial and Labour Relations Act or the Constitution of Zambia. The limitation is justified to promote democratic rotation of office and does not infringe on the right to association or participation in union activities. The plaintiff's mandate expired by effluxion of time, rendering his subsequent actions void. Amendments to the constitution must follow the prescribed procedures, and policy guidance from the Labour Commissioner is not legally binding until incorporated into the union's constitution.
