Procedural Posture

Civil Appeal / Judgment on Appeal

  1. 1 Whether the 1st respondent fraudulently sold the subdivision to the appellant to redeem the mortgage from the FRA
  2. 2 Whether the appellant is a bona fide purchaser for value without notice of a prior interest
  3. 3 Whether the beneficiaries of the estate are entitled to possession of the subdivision and the whole of Farm 3276, Kalamo

Ratio Decidendi

The 1st respondent had no authority to sell the subdivision as his letters of administration were revoked; the appellant failed to exercise due diligence and is not a bona fide purchaser for value without notice. The 9th respondent (Administrator General) is not liable for the sums awarded or costs as the transaction occurred before its appointment and there was no mismanagement of the estate. The principle of devastavit does not apply. The lower court's orders for refund and costs against the 1st respondent are upheld.

Court Disposition

Appeal dismissed

Orders

  • Order of the lower court upheld: 1st respondent to refund K420,000.00 (purchase price), K21,000.00 (property transfer tax), and K1,500.00 (registration fees, subject to assessment) to the appellant.
  • Costs to the 2nd to 7th respondents to be taxed in default of agreement.
