The trial magistrate exercised discretion capriciously by failing to provide reasons for refusing forfeiture of the vehicle used in the commission of the offence. The High Court was correct to overturn the order and direct forfeiture to the State. The sentence of two years imprisonment in default of payment of the fine exceeded the statutory maximum and was set aside in favor of nine months imprisonment in default.
