Ratio Decidendi

The Supreme Court held that the trust was created and cancelled by the deceased’s instructions before his death, and the funds became part of his estate, governed by the Will, which expressly excluded the respondent. The trial judge erred in holding otherwise and in finding the trust funds formed part of the residue property. The principles of equity required that the deceased’s intentions be given effect, and the funds were to be treated as part of the estate, not as a separate trust. The appeal was allowed, and the judgment of the trial court was set aside.
