Ratio Decidendi

The redundancy exercise was unlawful as it was implemented without prior approval of the Works Council, contrary to the mandatory requirements of Section 108(1)(e) of the Industrial Relations Act No. 36 of 1990. The purported approval after implementation was ineffective. The appellants' accrued rights under the repealed law were not extinguished by the subsequent repeal. Reinstatement is not appropriate; compensation is ordered.
