A bona fide appeal does not automatically entitle the appellant to a stay of execution; the court must exercise its discretion under Section 51 of the Supreme Court Act. The appellant failed to demonstrate irreparable harm or sufficient grounds for a stay, and partial payment had already been made. The issue of fraud under Section 17(2)(b)(iii) of the Arbitration Act is novel and will be determined in the main appeal. The status quo is to be maintained until the substantive appeal is heard.
