The appellant was entitled to gratuity at 100% of his basic salary for the third contract, as circulars B.8 and B.15 of 2001 applied to all personnel without distinction and accrued to him before circular B.25 of 2003 was issued. Circular B.25 could not lawfully reduce his accrued entitlement without his consent, and its discriminatory effect was not justified by law.
