Ratio Decidendi

The respondent was not a bona fide purchaser for value without notice, as he had actual and constructive notice of the appellants' interest. The sale by Aaron Kanyama to the respondent was void as Kanyama had no legal interest to transfer. The first judgment conferring 50% interest to Kanyama was a nullity for want of jurisdiction. The estate of Favour Chiyala is entitled to undivided ownership of the property, and the respondent's Certificate of Title must be cancelled and the Lands Register rectified.
