The Supreme Court held that the trial court correctly found, based on credible eyewitness evidence and the unchallenged 2007 traditional court judgment, that the land in dispute formed part of the estate of Robinson Nkaba Chooka and not Chalwe Nkaba. The 2007 judgment was valid, not fraudulently obtained, and was not appealed within the stipulated time. The 2012 judgment was obtained in the absence of the respondents and could not displace the 2007 judgment. The appeal was dismissed as it raised no viable legal or factual basis to overturn the trial court's findings.
