Ratio Decidendi

The Plaintiff's right of action accrued in 2008 when the alleged breach occurred. The Plaintiff commenced and discontinued an action within the limitation period but failed to recommence against the 2nd Defendant within six years. There was no fraudulent concealment to delay limitation. The joinder of the 2nd Defendant in 2016 was after expiry of the limitation period, rendering the action statute barred. Against the 1st Defendant, the Plaintiff admitted the funds were transferred as instructed, and no triable issue remained.

Claim dismissed as statute barred against both Defendants.
