Ratio Decidendi

The appeal failed because the Appellant did not prove to the required standard any corrupt or illegal practice, misconduct, or non-compliance that affected the result of the election. The trial Judge correctly applied section 97 of the Electoral Process Act, found no evidence that the alleged acts prevented the majority of voters from electing their preferred candidate, and determined that irregularities in GEN 12 forms did not affect the election result. Section 97(3) does not constitute a separate ground for nullification. The election was conducted substantially in accordance with the Act.
