Ratio Decidendi

The respondent, as a former ZCCM employee, was eligible and validly purchased the house in 1998 before any offer was made to the appellant. The appellant, though a sitting tenant and government employee, was not a ZCCM employee and thus not eligible under the applicable scheme. The subsequent offer and sale to the appellant was erroneous and null and void as the house was no longer available for sale. The respondent's purchase was not rescinded, and ZCCM's policy and the law supported the respondent's claim.
