Ratio Decidendi

There is no common law or statutory right of first refusal for tenants in Zambia unless expressly provided for in the lease agreement or applicable statute. The appellants' tenancy agreements did not contain such a right, and the respondents were under no obligation to offer the property to the appellants before selling to a third party. The sale was a lawful exercise of the respondents' rights as property owners and trustees, and the court cannot compel a sale to the appellants in the absence of a binding contractual or statutory provision.
