The Plaintiff was not validly selected and installed as Chief Chibwika because the established custom of rotation among royal families was not followed, the Plaintiff did not properly relinquish his position as Mwamba Ilunga, and the process excluded full participation of all eligible royal families and stakeholders. Senior Chief Kanongesha retains a traditional role in the process. The Plaintiff failed to prove entitlement to the reliefs sought.

Plaintiff's claim dismissed; Defendants' counterclaim succeeds.

  • The selection and installation of the Plaintiff as Chief Chibwika is nullified as contrary to custom of matrilineal succession and rotation.
