Ratio Decidendi

The Supreme Court held that the trial judge erred in nullifying the election based on Section 18(2)(b) of the Electoral Act, as it was not pleaded in the petition and there was no amendment to include it. Furthermore, there was no evidence that the non-compliance affected the result of the election in the whole constituency, as required by Section 18(4). The trial judge also misapplied the standard of proof. The appeal was allowed, and the election of Catherine Namugala was upheld.
