The trial judge failed to give adequate consideration to the gravity of the provocation caused by the wife's confession and intention to commit adultery. The appellate court found that, properly assessed, the provocation was grave and sudden, and the proportionality of the response was not so clearly out of all proportion as to preclude a reduction to manslaughter. The conviction for murder was quashed and substituted with manslaughter.
