Ratio Decidendi

The continued stay in office by Cabinet Ministers, Provincial Ministers, and Deputy Ministers after the dissolution of Parliament is unconstitutional, null and void, as their appointments are tied to being Members of Parliament and the amended Constitution does not provide for their continuation post-dissolution. The Vice-President may continue in office until the President-elect is sworn in, based on transitional provisions. Ministers, Provincial Ministers, and Deputy Ministers must refund all salaries and allowances received after dissolution of Parliament.
