The appellant's arrest and initial detention were based on reasonable and probable cause due to suspicion of theft. However, his continued detention for more than 24 hours without being brought before a competent court or released on bond was unlawful and in breach of section 33(1) of the Criminal Procedure Code. The claims for loss of business and malicious statement failed as the contracts were with the appellant's company and no evidence of the alleged statement was adduced.
