Procedural Posture

Employment Complaint / Judgment

  1. 1 Whether the complainant's dismissal from employment was wrongful and unfair thereby entitling him to damages
  2. 2 Whether the complainant is entitled to the payment of the sum of Kl3,728.92 for accrued leave days for the year 2018 and 2019
  3. 3 Whether the complainant is entitled to the payment of terminal benefits that would have accrued to him had he not been dismissed from employment

Ratio Decidendi

The complainant was dismissed for reasons related to conduct and performance. The respondent summoned him to exculpate himself on multiple occasions, both verbally and in writing, but he deliberately failed to attend or respond. The respondent thus complied with statutory and contractual requirements to afford him an opportunity to be heard. The dismissal was not wrongful or unfair. The respondent failed to prove payment for accrued leave days for 2018 and 2019, so the complainant is entitled to payment for those. The claim for terminal benefits for periods not worked is dismissed as it would amount to unjust enrichment.

Court Disposition

Partly allowed
