Procedural Posture

Judicial Review (application for Certiorari) / Judgment on Substantive Application for Certiorari

  1. 1 Whether the tribunal/board of inquiry had jurisdiction to investigate disciplinary charges against a senior prison officer under the Federal Prisons Act, 1955
  2. 2 Whether the tribunal was properly constituted under the relevant statutory provisions
  3. 3 Whether the High Court of Northern Rhodesia had jurisdiction to grant certiorari in respect of federal authorities and proceedings

Ratio Decidendi

The tribunal that purported to try the applicant was not constituted in accordance with the statutory provisions of the Federal Prisons Act, 1955, and lacked jurisdiction to conduct the inquiry. Its findings and the subsequent confirmations and dismissals were therefore nullities. The High Court of Northern Rhodesia had jurisdiction to grant certiorari to quash the proceedings, as the record was within its territorial jurisdiction and the tribunal purported to act under statutory authority.
