Procedural Posture

Criminal Appeal / Judgment on Appeal

  1. 1 Whether the trial court failed to direct its mind to the proviso to section 138(1) of the Penal Code in arriving at a conviction
  2. 2 Whether the trial court's judgment met the standard required under section 169 of the Criminal Procedure Code

Ratio Decidendi

The trial court properly explained the proviso to section 138(1) of the Penal Code to the appellant at plea, and the appellant did not rely on the statutory defence at the defence stage. The judgment met the requirements of section 169(1) of the Criminal Procedure Code, and the evidence against the appellant was overwhelming, including his own admission and corroborating medical evidence. There was no prejudice to the appellant, and both grounds of appeal fail.

Court Disposition

Appeal dismissed; conviction and sentence upheld.

Orders

  • Appeal is dismissed.
  • Conviction and sentence of 20 years imprisonment with hard labour are upheld.
