The Plaintiff's Affidavit in Reply was set aside for containing extraneous matter contrary to the mandatory provisions of Order 5, rules 15 and 16 of the High Court Rules. However, the defect in the affidavit is regulatory and curable, and the Plaintiff is allowed to file a fresh affidavit conforming to the rules.
