Ratio Decidendi

The Supreme Court held that the High Court erred in entertaining a contentious dispute over land ownership under the summary possession procedure of Order 113 RSC, which is reserved for non-contentious cases involving trespassers without colour of right. The proper course was to convert the proceedings to continue as if begun by writ under Order 28 r 8 RSC. The failure to do so was a procedural irregularity that vitiated the trial. The judgment and trial proceedings were set aside and the matter remitted to the High Court for retrial before another judge.
