The Plaintiff failed to prove on a balance of probabilities that the Defendant executed the alleged loan agreement for US$140,000.00. However, the Defendant admitted and evidence established that it received US$100,000.00 from the Plaintiff, which it has not repaid. To prevent unjust enrichment, the Defendant is ordered to refund the Plaintiff US$100,000.00 with interest at the prevailing SOFR rate from 24th December, 2019, until payment in full.
