  1. 1 Whether the Industrial Relations Court erred in ordering payment of security for costs against the defendant before hearing its defence
  2. 2 Whether failure to pay security for costs justified judgment without hearing the appellant's defence

Ratio Decidendi

The Industrial Relations Court erred in law by ordering payment of security for costs against the appellant, a defendant, before hearing its defence. The relevant rules do not empower the court to order security for costs against a defendant merely defending a claim. The proper remedy for wasted court days is an order for costs, not security for costs. The order was a misdirection and amounted to a denial of justice.
