Ratio Decidendi

Article 72(2)(h) does not apply to nullification of a parliamentary seat by the High Court; it applies only to disqualification by decision of the Constitutional Court. Article 73(4), when read purposively with Article 73(3) and related provisions, means that a Member of Parliament whose election is nullified by the High Court and who appeals to the Constitutional Court retains the seat pending determination of the appeal. The literal interpretation would lead to absurdity and is not what the framers intended.
