Procedural Posture

Constitutional Petition / Judgment

  1. 1 Whether the Petitioner, having requested early retirement on his own volition, qualifies for a pension benefit within the contemplation of Article 189(2) of the Constitution as amended
  2. 2 Whether the Petitioner was entitled to be retained on the Respondent's payroll following separation until payment of pension benefits

Ratio Decidendi

The Petitioner, having met the conditions for early retirement and having his request accepted by the Respondent, qualified for a pension benefit under Article 189(2). The Respondent's removal of the Petitioner from the payroll before full payment of pension benefits was contrary to the Constitution. Retention on payroll entitles the Petitioner to continued salary until all benefits are paid, not merely payment of benefits by instalments.
